
Terms and Conditions
By continuing to access the Studio 61 Pilates studio or website (including social media pages) you are agreeing to comply with and be bound by the following Terms and Conditions of use, which together with the privacy policy, govern Studio 61 Pilates ’s relationship with you in relation to the website and studio. The term ‘you’ refers to the user or viewer of our website/studio. We reserve the right to update, change or replace any part of these Terms and Conditions at any time. It is your responsibility to periodically check our website for changes. If you disagree with any part of these terms and conditions, please do not use this website, social media page or studio.
Studio 61 Pilates TERMS & CONDITIONS
Please read through the Terms and Conditions on our website, social media pages or the physical copy provided in person thoroughly before enrolling for a class. When registering as a client at Studio 61 Pilates, you agree to the terms and conditions as laid out on our Instagram or Facebook, or provided in person:

Our studio is an inclusive space. We will not tolerate any kind of discrimination or behaviour that creates a hostile and unpleasant environment for staff or members.

We endeavour to deliver all our classes on time and as advertised, however classes are subject to change or be cancelled without notice. Studio 61 Pilates is not liable to refund, transfer or offer compensation of any kind for classes that are late, changed or cancelled for any reason.

Out of consideration for the teacher and other clients we ask that you arrive at least 3 minutes before the start time of the class. If you are late, your class time will not be extended.

A minimum of two people is required for a group class to go ahead. You will be contacted via text or email should a class be cancelled and your session will be credited back to your account.

Cancellations/rescheduling classes need to be made more than 12 hours prior to when to class begins. Late cancellations will incur a lost session payment to the value of the session.

Sessions are not transferrable to another individual and cannot be used by another person. If someone other than the person booked into the class arrives to use the session, they will be asked to create an account and purchase their own sessions.

Bookings are to be made via the Studio 61 Pilates Facebook, Instagram, email or booking system (when available). Bookings are not confirmed until you have had a confirmation response.

To book into a class you must either have credit in your account or pay at the time of booking. Classes are on a first come first serve basis and can be booked up to 30 days in advance.

Studio 61 Pilates is not responsible for the safekeeping of your belongings when attending a class in studio.

Studio 61 Pilates has the right to refuse entry at any time. Our instructors reserve the right to direct clients to a particular class type for safety reasons; instructors also reserve the right to turn clients away for any reason they deem necessary (for example, injuries, failing to follow the instructions given,).

Clients must follow the instructions given around how to use, operate and exercise on the Reformer and/or any other equipment that is used both in (and out if applicable) the studio. Failing to do so may result in you being asked to leave the studio and forfeiting your class.

Classes at Studio 61 Pilates may be physically strenuous and you voluntarily participate in them with full knowledge that there is risk of personal injury, property loss or death. You agree to follow all instructions given to you by Studio 61 Pilates instructors and you acknowledge that any failure to do so will be at your own risk. Studio 61 Pilates is in no way liable for any injury, loss of property or death resulting from attending our studio.

Because we rely heavily on social media for advertising, there may be times when the class is filmed or pictures are taken to be put onto social media. If you prefer not to be shown in our videos and pictures on social media, it is your responsibility to tell the instructor at the start of class. We have no control over clients posting content that shows other clients in the studio; we may reshare this content on our social platforms.

By booking into and participating in a class* you automatically agree to these terms & conditions.

*This includes live or recorded online classes as well as those in our Content Library.
CANCELLATION POLICY

Class cancellations are the responsibility of the person booking the class and can be made via private message or the website.

Class cancellations can be made up to12 hours prior to your class start time without penalty.

Clients who pre-book a class but cancel the booking less than 12 hours prior to the class start time will forfeit their class and the credit will not be returned to your account for this missed class.

In exceptional circumstances we will waive our cancellation policy. Exceptional circumstances include self or direct family in hospital, death in direct family and natural disasters. Direct family refers to parents, siblings, spouse and children. In any circumstance other than these, the cancellation will not be waived.

Fluctuations in traffic/day-to-day work/school/social/family schedules do not constitute and are not considered exceptional circumstances.
PRIVATE SESSIONS

Private session cancelation credit will remain valid for 1 month from the date of the cancelation (as long as the cancelation is within our policy guidelines).

Extensions on these are only available upon sudden illness or injury, in which case we will request a medical certificate. Extensions due to medical reasons must be requested before the expiry date. Session packs are non-transferable and non-refundable.

Any non-cancellations, no show or absence will result in forfeiting that visit. If you do not attend a booked session or cancel within 12 hours of the class start time, you will be charged for the class.

Studio 61 Pilates has the right to terminate a class/session without notice for any unsatisfactory behaviour or other reasons decided by us, which occurs on our premises, in writing, or is directed at our staff or other members.
CONCESSION CARDS

Concession Cards are valid for three months from the date of the first class booked.

Concession Card extensions are only available upon sudden illness or injury, in which case we will request a medical certificate. Extensions due to medical reasons must be requested before the expiry date. Concession Cards are non-transferable and non-refundable.

Concession Cards cannot be shared. Anyone found to be sharing their pass will be denied entry and have their pass cancelled.

Any non-cancellations, no show or absence will result in forfeiting that visit. If you do not attend a booked session or cancel within 12 hours of the class start time, you will be charged for the class.

Studio 61 Pilates has the right to terminate a pass without notice for any unsatisfactory behaviour or other reasons decided by us, which occurs on our premises, in writing, or is directed at our staff or other members.
ZOOM SESSIONS

The Zoom session conditions are the same as outlined for ‘Private Sessions’.
NO SHOWS

Clients who pre-book a class but fail to attend will forfeit their class and the credit will not be returned to your account for this missed class.
PRICING & REFUNDS

All prices are quoted in New Zealand Dollars ($NZD) and all transactions are processed in New Zealand Dollars ($NZD). Prices, products and offers include GST.

All prices are correct at the time of online publication. Prices are subject to change without notice.

Sale items are only available at the lower price during the sale period.
-
Unforeseen supply problems or unexpected demand may occasionally result in stock being unavailable.

We reserve the right to amend prices and printing errors.

Prices may increase from time to time to reflect increases in cost and benefits. To keep you healthy, we must keep our business healthy.

All purchases are final. Studio 61 Pilates does not offer refunds, transfers, or products for change of mind, change of address or any other reason. We will consider extensions on class packs upon sudden injury, illness with a medical certificate and pandemic-related lockdowns.

All Concession Cards and classes are non-transferable between clients.

Studio 61 Pilates reserves the right to bill the client the cost of any additional bank fees which may incur from disputed or failed transactions regarding a clients account.

All payments are processed through Stripe, which is a third party online payment system. Studio 61 Pilates is not in control of any additional fees that may be charged as a result of card fees or clients having insufficient funds during payments. Refunds through Stripe may take 7-10 working days and will go back onto the card that was used for the original purchase.

Refunds will not be given unless goods/services are not provided. In the case of concession cards, these are non-refundable and make up classes will not be given if a session is missed as a result of the client being unavailable Studio 61 Pilates is unavailable a class credit will be provided.
GIFT CARDS

Gift Cards can be used for classes or merchandise at Studio 61 Pilates.

Gift Cards are not redeemable for cash and are not transferable.

Studio 61 Pilates does not offer refunds, transfers, suspensions or extensions on Gift Cards for change of mind, injury, illness, change of address or any other reason. All purchases are final.

We accept no responsibility if a gift card is lost, stolen, destroyed, or used without your permission.

Gift Cards may be purchased by emailing studio61pilates@gmail.com. Our Gift Cards have a 6 month expiry date from date of purchase. No change will be given for money left over on Gift Cards.

STUDIO DEALS AND SPECIAL OFFERS

Studio deals and special offers cannot be shared, suspended/extended or refunded for any reason.

The terms and conditions listed with any studio deals and special offers apply.
WAITLIST

Our waitlist system operates as a 'First in, first served' approach and works as follows: When a spot becomes available, those on the waitlist will be notified first, then an Instagram and Facebook story with the available time will be posted.
CLIENT WAIVER

A client waiver will be provided to each client before participating in any sessions or activities at Studio 61 Pilates.
PRIVACY POLICY

We are committed to ensuring that your information is secure. A copy of our Privacy Policy will be provided to clients upon their first visit. In order to prevent loss, misuse, unauthorised access, modification, disclosure, alteration, or destruction we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online. However, you should keep in mind that the transmission of information over the Internet is not completely secure or error-free. In particular, e-mails sent to or from our website/email address/booking system may not be secure, and you should therefore take special care in deciding what information you send to us via e-mail. We may collect the following information:

- Contact information including e-mail address
- Date of birth
- Emergency contact person
- Payment history
- Demographic information such as postcode
- Other information relevant to customer surveys and/or offers
- Sensitive information
